Information Pursuant to Law No. 6698 on the Protection of Personal Data
This Disclosure Text has been prepared by Bülbülzade Education, Health and Solidarity Foundation (“Bülbülzade Foundation” or “Foundation”) acting as the data controller, in accordance with Law No. 6698 on the Protection of Personal Data (“Law”), to inform data subjects about the procedures and principles regarding the processing of personal data and special categories of personal data obtained or to be obtained by the Foundation. Within this scope, Bülbülzade Foundation processes, stores, safeguards, and, where provided by the Law, transfers personal data only to the necessary extent, in connection with the purposes specified under the Law, in a limited and proportional manner, and only within the purposes that require processing of the data, domestically and/or abroad, to third parties under the conditions provided by the Law.

1) Purpose of Processing Personal Data
Through the methods described under this Disclosure Text, the Foundation processes personal data and special categories of personal data such as identity information, contact information, visual records, health information, biometric data, financial information, educational and resume information, of Foundation members, other rights holders related to Foundation members, and individuals who were previously Foundation members but no longer benefit from the Foundation and are not members, in accordance with the personal data processing conditions specified in Articles 5 and 6 of the Law, for the purposes of:
i) Enabling the relevant individuals to benefit from the Foundation services,
ii) Ensuring the communication of the Foundation internally and with relevant official institutions,
iii) Providing necessary services to the relevant individuals by the Foundation,
iv) Compliance with the Labor Law, Social Security Legislation, and other legislation applicable to the Foundation,
v) Compliance with information retention, reporting, notification, and other obligations prescribed by official institutions and legislation, and
vi) Using the right to defense against legal claims when necessary.
In addition:
i) Personal data such as identity information, contact information, and visual records of Bülbülzade Foundation employees managing Foundation activities and processes,
ii) Personal data such as identity information and visual records of visitors to the Foundation, and
iii) Identity information and contact information of individuals in a legal relationship with the Foundation
are processed by the Foundation acting as data controller for purposes such as operational and communication activities, contract procedures, access authorization, organization and event management, and ensuring physical and information security. Finally, as a result of membership verification applications made at the Foundation by other legally similar foundations or by the individuals themselves, the identity data of the individuals subject to the application and, if any, their spouses and children, are processed by the Foundation for the purpose of determining whether their membership exists.
The above-mentioned personal data and special categories of personal data of Foundation members, other rights holders, and former members are processed and stored for the durations required by the purposes of processing and, if necessary, indefinitely under social security legislation.
Personal data of Bülbülzade Foundation employees, visitors to the Foundation, individuals in a legal relationship with the Foundation, and individuals subject to membership verification applications are processed and retained for a maximum of ten years under the general statute of limitations for civil and criminal cases.
2) Method and Legal Basis of Collecting Personal Data
Personal data and special categories of personal data described above are collected verbally and/or in writing, physically and/or electronically, personally by data subjects, and/or via telephone, SMS, email, and other communication channels.
Collected personal data are processed and transferred within the legal grounds specified in Articles 5 and 6 of the Law, including:
i) Establishment and performance of a contract,
ii) Explicitly stipulated by law,
iii) Establishment, exercise, or protection of a right, and
iv) Fulfillment of our legal obligations.
3) Parties to Whom Personal Data May Be Transferred and Purpose of Transfer
The personal data and/or special categories of personal data of the above-mentioned individuals may be transferred, within the personal data processing conditions set forth in Articles 8 and 9 of the Law, to the Foundation’s relevant employees, occupational physicians, hospitals, ambulance service providers, and other health institutions and organizations, actuaries, persons or entities permitted and/or required by the relevant legislation, courts, enforcement offices, and other official institutions and organizations, as well as real and legal persons and/or institutions providing services to carry out Foundation activities, cooperation or agreement-based audit firms, software companies, insurance companies, for purposes such as:
i) Enabling data subjects to benefit from the Foundation services,
ii) Ensuring communication of the Foundation internally and with relevant official institutions,
iii) Providing necessary services to them by the Foundation,
iv) Compliance with Labor Law, Social Security Legislation, and other legislation applicable to the Foundation,
v) Compliance with information retention, reporting, notification, and other obligations prescribed by official institutions and legislation, and
vi) Using the right to defense against legal claims when necessary.
After the personal data of the above-mentioned individuals are transferred to actuaries engaged by the Foundation within the scope of the above-mentioned purposes, they may be transferred by the actuaries acting as data processors to other actuaries located abroad for the purpose of carrying out and managing actuarial services.
In the context of evaluating and managing Foundation membership, identity data of real persons who are/will be Foundation members and, if any, their spouses and children, are transferred to other legally similar foundations to determine whether their membership exists in these foundations.
Finally, the personal data and special categories of personal data obtained or to be obtained by the Foundation regarding the above-mentioned individuals are transferred to Bülbülzade Foundation acting as data processor for the purposes of storing and retaining these data.
4) Your Rights under the Law
Data subjects have the right to:
a) Learn whether personal data and special categories of personal data are processed,
b) Request information if processed,
c) Learn the purpose of processing and whether data is used accordingly,
ç) Know third parties to whom data has been transferred domestically or abroad,
d) Request correction if data is incomplete or inaccurate,
e) Request deletion/destruction under the conditions set forth in Article 7 of the Law,
f) Request notification of third parties to whom data has been transferred according to (d) and (e) above,
g) Object to results arising solely from automatic processing,
ğ) Request compensation for damages in case of unlawful processing.
Requests regarding your rights as data subjects can be submitted by completing and signing the application form (Personal Data Subject Application Form) available on the Foundation website and sending it to [email protected], delivering it in person, or via notary. The Foundation will conclude your request free of charge within 30 days, unless additional costs are required, in which case the fees determined by the Personal Data Protection Board will apply.
